TERMS & CONDITIONS (PAYWALL / SUBSCRIPTION)
Effective date: 01 January 2026
These Terms & Conditions (“Terms”) govern the use of:
- Purple Wealth website: www.purplewealth.co.za (“Purple Wealth Site”), and
- HI Financial Planning website: www.hifinancialplanning.com (“HI Site”), together, the “Sites”, including any member-only areas, content libraries, downloads, tools, research notes, newsletters, events, and other services accessible via a PayFast-enabled paywall (collectively, the “Services”).
1) Who we are
The Sites are operated by the entities listed in Annexure A (“we”, “us”, “our”). Each Site may be operated by a different legal entity.
2) Acceptance of these Terms
By accessing or using a Site (including by creating an account, subscribing, or purchasing access), you agree to these Terms. If you do not agree, do not use the Site or Services.
3) Eligibility and capacity
- You must be at least 18 years old (or have legal capacity) to subscribe or purchase access.
- If you use the Services on behalf of a company or other juristic person, you confirm you are authorised to bind that entity.
4) Accounts and login security
- You may need an account to access paywalled content.
- You are responsible for safeguarding your login credentials and for all activity under your account.
- Notify us immediately if you suspect unauthorised access.
5) What the Services are (and are not)
- The Services may include financial education, articles, commentary, research, calculators, downloadable resources, and/or member-only content.
- No advice unless expressly agreed in writing. Unless we have a separate signed mandate/engagement letter with you that expressly provides regulated financial advice or intermediary services, the member content is general information only and not tailored advice.
- You remain responsible for your investment, tax, and legal decisions. Seek professional advice where appropriate.
6) Subscriptions, paywall access, and pricing
- Paid access may be offered as recurring subscriptions (monthly/annual) and/or once-off purchases (time-bound passes, single reports, event tickets, etc.).
- Prices, billing frequency, and what is included are shown at checkout and/or on the pricing page, and form part of these Terms. All prices are in ZAR unless stated otherwise.
- We may update pricing or packaging from time to time. Any changes will apply prospectively (for example, from your next renewal date) unless otherwise stated.
7) Payments via PayFast (payment processing)
- Payments are processed via PayFast (a third-party payment processor). Your payment may be subject to PayFast’s processes, security checks, and legal terms.
- We do not store your full card details on our servers (card entry is handled on PayFast’s secure environment or as otherwise provided by PayFast).
- If PayFast declines a transaction or a recurring payment fails, we may suspend or restrict your access until payment is successfully processed.
8) Recurring billing authorisation (subscriptions)
- If you choose a subscription, you authorise PayFast to debit/charge your selected payment method on a recurring basis at the agreed frequency until you cancel (or the subscription term ends).
- You can cancel your subscription using the cancellation method described on the Site and/or via your PayFast subscription management, where applicable.
- Cancellation stops future renewals. Unless stated otherwise at checkout, cancellation does not automatically refund amounts already paid for the current billing period.
9) Refunds, reversals, and chargebacks
- General rule: Fees are payable in advance for the access period purchased. Unless required by law or expressly stated in a specific offer, we do not provide pro-rata refunds for partial use of a subscription period.
- Where we approve a refund, it will generally be processed back to the same payment method used for the original transaction and cannot exceed the original amount, consistent with PayFast’s rules.
- If you initiate a chargeback without first raising the issue with us, we may suspend your account while we investigate. You remain liable for any amounts legitimately due, and we may recover reasonable costs incurred in responding to chargebacks where permitted.
10) Cooling-off and consumer rights (South Africa)
- South African e-commerce rules may provide consumers a statutory cooling-off right in certain electronic transactions and related obligations around secure payment systems.
- Any statutory rights you have under applicable law remain unaffected by these Terms. Where the law gives you a right to cancel/refund, we will apply it.
11) Access rules and fair use
- Your subscription/access is for your personal use (or your organisation’s internal use if purchased for that purpose) as described at checkout.
- You may not share logins, resell access, provide paywalled content to third parties (unless an enterprise licence explicitly allows this), scrape/harvest content, or bypass or attempt to bypass the paywall or security features.
12) Intellectual property
- All content on the Sites (including text, branding, research, videos, tools, templates, and downloads) is owned by or licensed to us and protected by intellectual property laws.
- You receive a limited, non-transferable, revocable licence to access and use the content for its intended purpose during your access period.
- You may not reproduce, redistribute, publish, adapt, or create derivative works from the content without prior written permission, except to the extent permitted by law.
13) User submissions (if applicable)
If you submit comments, messages, documents, or other content (“User Content”): you warrant you have the rights to submit it; and you grant us a non-exclusive, royalty-free licence to use it for operating and improving the Services (unless you and we agree otherwise in writing).
14) Prohibited conduct
You may not use the Sites to break any law or infringe any rights; upload malicious code or spam; attempt unauthorised access; impersonate others; or interfere with the operation or security of the Sites.
15) Disclaimers (important)
- Content is provided “as is” and may change without notice.
- We do not guarantee the accuracy, completeness, timeliness, or fitness for purpose of any content, except where required by law.
- Markets involve risk. Past performance is not a reliable indicator of future results.
16) Limitation of liability
- To the maximum extent allowed by law, we are not liable for indirect or consequential loss, loss of profits, loss of data, or business interruption arising from use of the Sites or Services.
- Our total aggregate liability for claims relating to a paid subscription/purchase will not exceed the amount you paid to us for that specific subscription/purchase during the 3 months before the event giving rise to the claim (or such other cap as required by law).
- Nothing in these Terms limits liability where it cannot legally be excluded.
17) Indemnity
You agree to indemnify us against claims, damages, and expenses arising from your unlawful use of the Sites, your breach of these Terms, or infringement of third-party rights.
18) Availability, maintenance, and changes
- We aim for good uptime but do not guarantee uninterrupted access. Maintenance, upgrades, or PayFast/service provider issues may affect availability.
- We may modify, suspend, or discontinue parts of the Services (including content libraries) from time to time.
19) Privacy and POPIA
- Our collection and processing of personal information is governed by the relevant Site’s Privacy Policy (linked on the Site).
- PayFast processes personal information for payment processing in accordance with its privacy policy.
20) Communications
We may send service-related communications (billing notices, access notices, policy updates). Marketing communications will be sent only where lawful and with appropriate opt-out mechanisms.
21) Third-party links
The Sites may link to third-party sites or tools. We are not responsible for their content, availability, or policies.
22) Breach and termination
- We may suspend or terminate your access immediately if we reasonably believe you have breached these Terms, engaged in fraud, or misused the paywall.
- If access is terminated for breach, refunds are not payable (unless required by law).
23) Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa. The parties consent to the jurisdiction of the South African courts, subject to any mandatory consumer protections.
24) Changes to these Terms
We may update these Terms from time to time. The latest version will be posted on the relevant Site with an updated effective date. Continued use after changes means you accept the updated Terms.
